A special inspector general of police in Maharashtra and 16 handpicked men oversaw Operation X leading to the death by hanging of Pakistani terrorist Ajmal  Kasab on Wednesday.  The process was quietly initiated shortly after President Pranab Mukherjee rejected Kasab's mercy plea on November 5, official sources said.

The chosen team's mission was to hang and bury the 25-year-old Kasab in complete secrecy in Pune's Yerawada Central Jail, where he would be moved from Mumbai.

Once home minister Sushilkumar Shinde signed the file from the President's office on November 7 and sent it to the Maharashtra government the next day, the police team took charge.

Only a handful knew that Kasab would hang on November 21 morning.

These included Mumbai Police Commissioner Satyapal Singh, earlier the Pune police chief, and Meeran Borwankar, who heads the Yerawada jail, and those at the helm in the state intelligence department and Mumbai CID.

Yerawada is one of the two jails in Maharashtra--the other being Nagpur Central Jail--where hanging facilities are available.  Pune's proximity to Mumbai played a role. An expert hangman was summoned.

On November 12, Kasab had been told of his impending hanging by a jail staff in Mumbai. According to chief minister Prithviraj Chavan, Kasab was quietly shifted from Mumbai to Pune on November 19.

He was taken on a special flight late at night to reach Pune early November 19 and whisked off to the Yerawada jail. He requested that his mother be informed, and indicated he had no last wish. He did not want to make a will or any final testament.

As state home minister R.R. Patil put it, after completing all legal niceties, Kasab was executed at 7.30am on Wednesday. Just 15 minutes later, the Operation X chief conveyed to the state home department that the task was "successfully completed". (IANS)

The Delhi High Court restrained a media house from publishing, telecasting and broadcasting the contents of the sex tape.  Singhvi claimed that such a CD either does not exist or if it does, it is clearly and obviously morphed, fabricated and forged.Later, on 18th April, Congress party, the party to which Singhvi belongs released a statement declaring that the CD was a personal matter of the senior lawyer. On 19th April the video went public on Facebook, YouTube and other social networking sites.Singhvi then blamed social media sites for sensationalism and claimed an organised gang was involved in broadcasting CD contents despite a court injunction .

Views ::184 Congress on Thursday alleged grave irregularities in MCD, saying that the financial position of the corporation is very bad and it is neck deep in debt.

"The financial position of the corporation is very bad. It has not been managed for the five years. There is a liability of around Rs 3,000 crore and it owes around Rs 1,000 crore to contractors and other workers," Delhi Pradesh Congress Committee (DPCC) president Jai Prakash Agarwal told reporters.

He alleged that the corporation is neck-deep in debt and those who could not manage it for these five years cannot manage it in future and can do nothing for its betterment.

Agarwal was addressing press while announcing the constitution of an election campaign committee for Municipal Corporation of Delhi (MCD) polls.

The committee will have Agarwal as its chairman and Delhi Chief Minister Sheila Dixit, Union ministers Kapil Sibal, Ajay Maken and Krishna Tirath as its members among others. The other members of the committee include MPs Sandeep Dixit, Janardhan Dwivedi, Karan Singh and Delhi government ministers AK Walia, Kiren Walia, Arwinder Singh Lovely and Haroon Yusuf.

Views ::236 The civic elections in Delhi have lost their carnival spirit, feel many political parties and candidates, due to the state election commission's strict code of conduct which has banned poster campaigns and restricted the use of loudspeakers and the sale of liquor.

"Posters and hoardings were one of the easiest and most traditional ways to woo voters. But the election commission's strict restriction has now made it all very difficult," lamented an independent candidate contesting the April 15 polls from east Delhi.

Rakesh Mehta, Delhi's state election commissioner said: "If candidates are found defacing public or private properties by putting up posters or writing with ink or any other material, it won't be tolerated. Putting up posters and banners on trees would also invite action under provisions of the Delhi Prevention of Defacement of Property Act."

According to the Act, which came into force in March 2009, sticking of posters and banners and wall-writings on public properties is a cognizable offence. The penalty is a fine of up to Rs 50,000, a jail term of up to one year, or both.

Apart from punitive punishment, the election commission has already set up a poster removal squad for each of the 12 MCD zones.

"The real fun of the elections is missing and at every step, we need to be cautious. The usual celebratory mood and festivities like poster campaigns, loudspeakers with party songs, vehicles carrying candidates associated with elections have been dropped. It is turning out to be a drab affair. We can't even keep the speakers out a little late in the night," a BJP party candidate, pleading anonymity said.

According to the state election commission, the candidates can use loudspeakers at a moderate volume only between 6 am and 10 pm. The sale and distribution of liquor will also be monitored during the election period. Liquor shops in the city will be shut April 13-15 and on April 17, the day the votes will be counted.

The BJP candidate also added that due to increased restrictions, many aspirants are reaching out via social media platforms like Twitter and Facebook.

"Most of the candidates have their Facebook and Twitter pages and they upload all photos and reply to comments on their Facebook page, but how much ever you access the voters through cyber world, there is nothing like a poster as we get an opportunity to pose with top leaders like Sonia Gandhi and Rahul Gandhi in the locality," a Congress candidate from South Delhi added.

Meanwhile sources in different parties said that strict instructions have been laid down by the election commission that the expenditure limit of Rs 400,000 per candidate should not be exceeded. Even so, it's an open secret that candidates will be quietly distributing freebies in the last few days of campaigning, which ends April 13.

The state election commission has also informed the candidates that the size of the party flags displayed on campaign vehicles should not exceed one-and-a-half-ft by one ft.

The banning of posters and hoardings and the fact that state election commission observers are keeping a strict vigil in each ward has been widely welcomed.

"Usually after elections, each and every wall in the capital is plastered with crores of posters. The task of cleaning up becomes difficult. But this time, by joining hands with election commission observers, we will not allow even a single election poster during civic polls," Col (retd) Shivraj Kumar, founder of the "Poster hatao" campaign, a citizen-centric initiative, said.

This will be the first election to the trifurcated Municipal Corporation of Delhi. While the corporations of north and south Delhi will each have 104 wards, there will be 64 wards in east Delhi. Fifty percent of the seats have been reserved for women.

Close to one crore voters will be eligible to cast their ballots on election day.

Court asks man to pay alimony to wife, 2 daughters
Views ::200 New Delhi: A tailor has been directed by a Delhi court to pay three-fifth of his earnings -- Rs 3,900 -- as monthly maintenance to his estranged wife and two minor daughters.

Metropolitan Magistrate Vandana Jain asked Jagjit Singh, also working as a property dealer, to give alimony to his wife and his minor children, who were mercilessly beaten up by the husband and his family members and were thrown out of the house at Vinod Nagar in East Delhi in March 2009.

"...I am of the view that the family cake is to be divided into five portions, out of which two portion is to be retained by the earning spouse and remaining three portions are to be divided amongst three petitioners (woman and her two minor daughters)," the court said.

The court's order came on a plea filed by the woman who said she was an unemployed lady and was unable to maintain herself and her minor girls, who are school going children.

Observing that the man has no other liability apart from maintaining his wife and his minor daughters, the court said, "Keeping into account the observations made above, respondent (man) is directed to pay maintenance to petitioner no 1 (woman) Rs 1,300 per month till the date of re-marriage or for life time and to his minor daughters Rs 1,300 each per month till attaining majority or till the time law otherwise permits."

The couple got married in 1999 at Arya Samaj Mandir in West Patel Nagar here, and two daughters were born in June 2000 and April 2002 respectively, the woman said.

The woman alleged that she was tortured by her husband and his family members at her matrimonial home for not brining dowry as per their expectations.

The woman's counsel told the court that she was beaten up mercilessly by her husband and was compelled to bring Rs five lakhs for starting some business of property dealing and as she refused to do so, she was thrown out of her matrimonial home in 2009.

During the pendency of the woman's petition, Singh had appeared in the court once but thereafter he preferred not to contest the plea.

Thumbnail Delhi: Inter-state child trafficking racket busted
Views ::204 New Delhi: In a major development, Delhi Police on Thursday busted an inter-state child trafficking racket active in the Old Delhi Railway Station area for quite some time and rescued at least 15 minor kids from their handlers.

According to report, a team of Delhi Police, acting on a tip off from an NGO Bachpan Bachao Andolan, also detained at least five persons in connection with the case.

Those detained are being questioned by the Delhi Police and could later be formally charged in cases related to illegal human trafficking.

Most of the kids, who were rescued in the operation, hail from Uttar Pradesh, Bihar and West Bengal.

They were being taken to Ludhiana by their handlers.

Efforts are being made to re-unite them with their parents in their respective states.

The development is important in view of shocking report released recently by Delhi Police, which said around 700 children have been found missing from the national capital in last three months.

The report also said that 252 children were reported missing in March alone.

The report is a major embarasment for the local administration in the national capital which boasts that New Delhi is one of the safest cities in the country.

Views ::202 Army chief's allegations that he was offered bribe rocked Parliament on Monday with both the Lok Sabha and the Rajya Sabha adjourning twice after Opposition uproar.

Placard-carrying members of TRS, TDP and Congress also trooped into the well in the Lok Sabha to demand creation of Telangana, while Rajya Sabha saw Congress member K Keshav Rao joining Prakash Javadekar (BJP) in slamming the government for the delay in creating the separate state.

Javadekar claimed that 609 persons had committed suicide on the issue of Telangana so far, saying the government needs to show political will to bring a bill for creation of Telangana. "NDA will support any such bill," he said.

Rao also came down heavily on the government for the delay in creation of Telangana, saying, "If you want three crore people to die, we are ready."

Javadekar demanded that his notice for suspension of Question Hour to discuss the Army chief's allegation be taken up. The opposition uproar led to the adjournment of the House till noon.

In the Lok Sabha, Congress members from Telangana, sporting black ribbons, and those from TRS and TDP rushed to the Well to press for statehood. Slogan-shouting JD(U) members were also in the Well demanding coal linkage for a power house in Bihar, forcing adjournment of the House till noon.

Views ::216 Congress on Sunday trashed the Gujarat government's claim that the chief minister had launched the Sadbhavna fasts on the directives of the Centre, saying “unless the BJP and Narendra Modi think that people of India eat grass, they would not have made such a laughable statement".

"If he (Modi) is so obedient of the Central directive, then why did he not follow his own party’s warning to observe Raj dharma..? Was it the Centre which told him to turn a Nelsonian blind eye when human carnage was going under his nose..?” party spokesman Abhishek Singhvi said when asked about his reaction over the issue.

There were media reports which stated that the Gujarat Home department had written to Governor Kamla Beniwal earlier this month noting that the Sadbhavana fasts had been held in the state to increase communal harmony.

The letter was reported to have said that this (fasts) was as per directions given to the "states by various ministries of the central government to maintain and strengthen communal harmony in the states and with a vision to empower national unity."

Singhvi remarked "unless the BJP and Narendra Modi think that people of India eat grass, they would not have made such a laughable statement".

Modi had launched the Sadbhavna Mission with a three-day fast on his birthday on Sept 17 last year. The 33 fasts concluded on February 12.

Gordhan Zadaphia, who was the Minister of state for Home in Gujarat during Modi's first stint as chief minister, has dismissed the state home department's explanation.

Zadaphia, a friend-turned-foe of Modi, has also sought to know "which circular of the Centre had directed Modi to fast for sadbhavna".

He had written four letters to the Governor on Modi's fasts seeking the expenses on it and the purpose.

Views ::172 BJP President Nitin Gadkari on Sunday hit out at NRI business Anshuman Mishra terming his allegations against party veteran Murli Manohar Joshi and some other leaders as "baseless" and an "expression of frustration" over his failure to make it to the Raja Sabha.

"Anshuman Mishra's motivated and selective tirade against some of the top BJP leaders is nothing but an expression of frustration over his failure to make it to the Raja Sabha with the support of BJP MLAs from Jharkhand," Gadkari, who is believed to have backed Mishra's nomination which he had to withdraw following protest from certain BJP leaders, said in a statement.

Dismissing Mishra's allegations as "baseless and misleading", he also urged the party rank and file to ignore this "deliberate" attempt to create confusion by spreading "falsehood".

The BJP President also appealed to media not to take cognizance of Mishra's "unsubstantiated and wild" remarks against senior BJP leaders and said that all of them have a "proven track record of probity in public life" and have always enjoyed an "unblemished reputation".

Mishra, who was supported by a section of the BJP as an independent nominee for Rajya Sabha from Jharkhand, had to withdraw at the last moment following a directive from the BJP central leadership to its MLAs not to vote for him.

On Saturday, he claimed to have introduced PAC Chairman Joshi to senior executives of 2G scam accused companies when the panel was probing the 2G spectrum case, a charge rubbished by the BJP veteran.

Mishra had also said that Joshi called him seeking funds for elections. Mishra claimed to have played a role in Joshi's poll campaign in 2004 and 2009.

Joshi had, however, maintained that Mishra's allegations were "fabricated" and whatever he was saying with regard to him is absolutely wrong and a "concoction".

The senior BJP leader had also asserted he had "strongly opposed" giving a Rajya Sabha ticket to Mishra when his opinion was sought.

Views ::160 The government on Monday denied media reports that the Army had unauthorisedly deployed phone tapping equipment in the capital and said that such stories are being spread by some retired officials.

In a written reply to Lok Sabha, Defence Minister A K Antony said, "No deployment of any phone tapping equipment at various places in New Delhi has been reported by the Army."

He was replying on whether the Army had unauthorisedly deployed phone tapping equipment, called off-the-air interceptors, at various places in New Delhi as reported in the media recently.

"Army Headquarters has informed that there are reports of such stories being spread by some retired officials," Antony told the House.

He also denied reports that the equipment were being utilised to unauthorisedly tap phones of senior government functionaries in and around New Delhi, and that his own office was allegedly bugged.

Antony informed the House that an anonymous complaint was made to the Defense Secretary detailing motive and 'modus operandi' of entire unauthorised tapping episode.

But he denied that government has ordered an inquiry into the facts and circumstances mentioned in the complaint.

In reply to another question, Antony said that the Defense Ministry has not received any report of spying.

"No case of spying has been reported in the Defense Ministry," he said when asked on whether government has taken cognisance of alleged reports of spying in the Defense Ministry.

Amid din over Assam Gana Parishad member Kumar Deepak Das' insistence on raising an issue concerning Assam, V Maitreyan (AIADMK) drew the attention of the Chair to vacant front rows of the treasury benches and shouted "no minister".
 
As soon as Maitreyan raised the issue, he was spontaneously supported by members of other opposition parties including BJP.

Deputy Chairman K Rahman Khan then looked around and asked "where is Cabinet Minster..?"

At this Sriprakash Jaiswal, who was seated in the back rows rushed to in the front bench sending members into peals of laughter..?

"Yes, Jaiswal is there. If you are not aware he is Cabinet Minister what can I say," Khan said in a lighter vein.

When Jaiswal took his seat on the front row, a Congress member Satyavrat Chaturvedi started chatting with him.

To this, Khan said the minister should be attentive. "I request the honorable member not to disturb the minister when the House is running," he said, to which the minister immediately obliged.

All this happened amid din as members from BJP, BSP and Left kept asking the Chair to allow Das to raise his issue relating to "national integration".

Views ::84  The Supreme Court on Monday expressed concern over the alleged ongoing illegal clinical trial of untested drugs in the country and said the government must take corrective measures.

"This is very unfortunate and the government must take corrective steps," said a bench of justices R M Lodha and H L Gokhale.

The bench also refused to implead Indian Society for Clinical Research (ISCR) for the time being for having its say during the hearing of a plea on the issue and asked it to prove its bonafide.

"People are dying. That is most unfortunate," the bench observed when senior advocate U U Lalit, appearing for the ISCR pleaded that the court should also hear its stand.

The ISCR is an association of clinical research professionals and the society brings together all those who are engaged in clinical research activities in India.

The bench asked the Centre, Medical Council of India to file their response within six weeks and posted the matter for further hearing on July 13.

MCD polls: Cong announces list of 263 candidates
Views ::77 New Delhi: Congress on Sunday announced its first list of 263 candidates for the Delhi municipal polls barring nine seats for which a consensus was not arrived at.

The list includes the names of present MCD Leader of Opposition Jai Kishan Sharma, former Mayor Farhad Suri and councillor Shalu Malik.

Nutan Kochar, wife of a prominent Congress leader Jitender Kochar, former DU University student's leader Amrita Dhavan, prominent local leaders Satbir Sharma, Ramesh Dutta and Anita Babbar also figure in the list.

Among the candidates, six women were fielded from general seats taking the total number of candidates from the fairer sex to 141. Candidates for two seats reserved for women are yet to be selected.

Fifteen Muslims, including seven women, also figure in the list which also has five doctors.

The seats for which candidates are yet to be finalised are Kirari Suleman Nagar (SC), Moti Nagar, Madipur (SC-W), Vishnu Garden, Khayala (W), Mahipalpur, Said-ul-Ajaib, GK-I and Brahmpuri.

A Congress leader said male sitting councillors whose seats did not fall under women wards were given party tickets.

Tomorrow is the last date of nominations and candidates for the the pending nine seats are expected to be finalised by late tonight or early morning, the leader said.

Views ::77 The display of Chief Minister Sheila Dikshit's photo on the State Election Commission's website has kicked up a storm here with Delhi Mayor and BJP leader Rajni Abbi today terming it as violation of model code of conduct by the electoral body.

In a letter to State Election Commissioner Rakesh Mehta, she said, "if the Election Commission itself commits the violation of the Code of Conduct, then how can it expect political parties and its candidates to follow the Model Code of Conduct."

Abbi said, "The State Election Commission is an independent body and when anybody opens its website for any information, the photograph of the Chief Minister leads to an obvious conclusion which I feel is the violation of the Model Code of Conduct as MCD elections are on an anvil".
 
She urged Mehta to look into the matter immediately and get it redressed.

Earlier, Congress councillors had approached the Commission against the BJP-ruled MCD's decision to clear proposals like sanctioning pensions after the model of code of conduct came into effect on March five.

Views ::77 New Delhi: The demand for partial rollback of the hike in the freight and passenger fare in the Railway Budget gained momentum on Tuesday with key UPA constituent DMK making a pitch for the reconsideration of the decision.

Participating in the discussion on the Railway Budget, DMK member E G Sugavanam asked the Government to "reconsider" the decision to increase the passenger fare hike that is around 35 per cent.

Demanding a "scaledown" of the rail passenger hike, he said it was essential to reduce the burden on common man.

Trinamool Congress has effected a change of guard by bringing in Mukul Roy as Railway Minister, unhappy over the proposal for a passenger fare hike by its nominee Dinesh Trivedi who presented the railway budget.

P C Chacko, who opened innings on behalf of the Congress, also noted that there could be a partial rollback insisting at the same time that the hike could not be considered reasonable given the financial position of the railways.

Ramachandra Dome (CPI-M) also demanded a rollback of the passenger fare hike.

Opposing the proposal to increase the freight charges, he said it will have an "inflationary and cascading impact" on the economy.

Views ::76 New Delhi: Railway Minister Mukul Roy on Tuesday blamed the van driver for the major accident at an unmanned level crossing near Hathras in Uttar Pradesh, which claimed 16 lives.

In his first statement in Parliament after assuming office, Roy said Rs two lakh have been announced for the next of the kin of the deceased and Rs 50,000 to the grievously injured besides Rs 25,000 to those with minor injury.

16 people were killed and three others seriously injured when the Mathura-Kasganj Express rammed into an overcrowded vehicle at an unmanned railway crossing this morning.

"As per preliminary information, the incident occurred due to negligent driving by the driver of the mini-van. The driver did not stop his van at the stop board short of level crossing to check for approaching train as prescribed," Roy said in a suo motu statement in Lok Sabha.

He said medical relief was immediately dispatched from Kasganj through an accident relief train. He said locals and civic authorities had shifted the injured to nearby hospitals by the time the relief train arrived at the spot.

The injured were moved to a local hospital at Badhwa and those requiring special medical attention were sent to medical college at Aligarh.

Roy said, "the accident took place at the unmanned level crossing 'C' which has very low traffic density".

Views ::77 The family members of the victim of a road mishap, involving a rashly-driven two wheeler, have been awarded a compensation of over Rs 43 lakh by a tribunal.

Presiding Officer of Motor Accident Claims Tribunal (MACT) Sanjay Kumar Aggarwal directed United India Insurance Company Ltd, with which the offending two-wheeler was insured, to pay Rs 43,60,139 to the wife and children of Ravinder Singh, who had died in a road mishap last April.

"Reading all the documents filed by the petitioners (the victim's family) as a whole it is clear that the respondent (Aasar Kapoor) was driving the vehicle in a rash and negligent manner.

"I award Rs 43,60,139 as compensation with interest at the rate of 7.5 per cent per annum, in favour of the petitioners and against the respondents (Aasar Kapoor, Dalip Kapoor and insurance company) on account of their liability being joint and several," the tribunal said.

The accident took place on April 4 last year when Tilak Nagar resident Aasar Kapoor hit Singh's motorcycle with his two-wheeler at a red light on Outer Ring Road near Keshopur, due to which Singh sustained grievous injuries and died later in the hospital, his family said.

The tribunal awarded the compensation to the victim's wife and kids, also residents of Tilak Nagar, after coming to the conclusion that Aasar was riding his motorcycle in a rash and negligent manner, on the basis of the documents filed.

"The insurance company is directed to deposit the award amount in the Bank of Maharashtra, Chandni Chowk Branch, in the name of the petitioners in terms of the award," it said.

Out of the total money, the MACT has apportioned 60 per cent to the wife of the victim and rest to his two daughters and minor son.

Views ::78 he Supreme Court on Monday said the courts cannot quash investigations in criminal offences in a casual manner as it would amount to miscarriage of justices and obstruction to the process of law.

The apex court said the high courts can exercise its extraordinary powers under Section 482 CrPC to quash criminal cases only in exceptional cases and the power cannot be exercised in an arbitrary manner.
 
"It is true that the inherent powers vested in the high court under Section 482 of the Code are very wide. Nevertheless, inherent powers do not confer arbitrary jurisdiction on the high court to act according to whims or caprice.

"This extra-ordinary power has to be exercised sparingly with circumspection and as far as possible, for extra-ordinary cases, where allegations in the complaint or the first information report, taken on its face value and accepted in their entirety do not constitute the offence alleged," the apex court said.

A bench of justices DK Jain and AR Dave gave the ruling while upholding an appeal by the Orissa Government challenging the state high court's decision to quash the probe initiated by the Vigilance Department of the state government into the allegations of irregularities in the receipt of excess quota, recycling of rice and distress sale of paddy by M/s Haldipada Rice Mill, a proprietary concern of one Ujjal Kumar Burdhan.

The apex court said unless a case of gross abuse of power is made out against those in charge of investigation, the high court "should be loath to interfere at the early / premature stage of investigation."

"We are constrained to hold that in the fact-situation at hand, the impugned decision is clearly indefensible," the bench said, while restoring the investigation.

The apex court said in the present case the SP, Vigilance Cell, had merely initiated an inquiry and even the FIR was yet to be registered.

"It goes without saying that commencement and completion of an investigation is necessary to test the veracity of the alleged commission of an offence. Any kind of hindrance or obstruction to the process of law from taking its normal course, without any supervening circumstances, in a casual manner, merely on the whims and fancy of the court tantamount to miscarriage of justice, which seems to be the case here.

"We, accordingly, allow the appeal, quash and set aside the impugned judgment and restore the investigation initiated against the respondent and direct the Vigilance Cell of the state to proceed with and complete the investigation expeditiously, in accordance with law," Justice Jain writing the judgement said.
